Court rules in favor of N. Whitehall Twp.
Solicitor Lisa Young told North Whitehall supervisors Lehigh County Court ruled in favor of the township in the appeal on the township's granting of conditional use for a wastewater treatment plant.
This plant is proposed to serve the area west of Route 309 and would include KidsPeace and the proposed Walmart shopping center.
Judge Edward D. Reibman ruled in favor of the township on all counts.
In other matters, Township Manager Jeff Bartlett told supervisors the end of July would be the starting date for road projects, weather permitting.
Sand Spring Road reconstruction is on schedule and the road should be open by the end of this month. The road is currently open to the school.
Resident Jim Morris said phone books are being delivered throughout the township and are not being picked up by homeowners.
He said this makes the property look unsightly and suggested this could be a form of littering.
He asked the board to do something to deal with the problem.
Ron Roth applauded Young for winning the judgment on the wastewater treatment plant appeal.
He said due to the appeal, a lot of money was spent needlessly.
Jeanene Bauer, a member of the citizens' group, Voice of the Jordan, averred their side is not the cause of the problem.
She emailed The Press Tuesday with comment on Reibman's decision.
"Judge Reibman's ruling is despicable; a complete affront to the Supreme Court," Bauer wrote. "Suffice it to say the Voice of the Jordan has appealed to the Pa. Commonwealth Court."
Resident John Pfeiffer wants the board to address solar energy with an ordinance relating to solar panels.
Apparently his neighbor has erected solar panels in his yard and Pfeiffer says the view is unsightly.
He realizes this cannot be changed but suggested the board address this in the future.
Bartlett said the project is not complete. Shrubbery or a fence must be placed at a minimum height of 6 feet.
Resident Kathy Smull of Coplay Creek Road contacted PennDOT about the installation of signs stating "No Tractor Trailer Trucks Except for Local Deliveries."
PennDOT is apparently agreeable to this providing it receives a letter from the township requesting the signs.
