Lynn Ag Security committee has public hearing on land additions

Zoey Farms LLC has asked to have 39.841 acres added to the Lynn Ag Security Area and Andrew Watson Jr. has two lots, one on Cardinal Road; the other on Bluebird Road that total 17.13 acres.

A public hearing was held at the Feb. 14 meeting of the Lynn Township supervisors and both lots were accepted.

Their approval had been recommended by the planning commission and ag security committee. There was no public comment on this issue.

A sewage module was accepted from Gary Snyder and will be forwarded to the Department of Environmental Protection.

Greg Snyder had a conditional final plan approval in November. He has been working with the DEP for module approval.

Lehigh County Authority will not take over the four laterals and a 6-inch pipeline as part of the Lynn sewerage system.

The DEP wants an agreement the laterals will be the responsibility of property owners.

Alan Fornwalt, alternate Keystone engineer, said the 6-inch pipe is only a 75- to 120-foot pipeline rather than a complete system.

Supervisor Justin Smith asked what the township's options are.

Solicitor Marc Fisher said everything can always come back to the township. He will draw up an agreement.

New Tripoli Assistant Fire Chief Gary Kuntz said firefighters responded to 155 incidents in 2012 and seven since the last meeting. Fire police are attending a HAZMAT class.

The company responded to an ethanol emergency in Germansville and will be attending a class on ethanol emergencies. The Ethanol E85 blend creates fires that are harder to put out, Kuntz said.

Roadmaster Bruce Raber reported his crew has been doing boom mowing, cleaning pipes and storm boxes, worked on the trucks, did some welding on the plow frames, fixed a guide rail and hauled recycled scrap.

Supervisor Brian Dietrich asked if there is a job description for an assistant roadmaster.

As there is not, one will be drafted and an assistant will be appointed in March. He will not be expected to report to the board at meetings unless he is in charge for an extended period.

Members are needed for the Environmental Advisory Committee.

Anyone interested can send a letter of interest to the township. Two appointments are required.

Secretary Tammy White said a phone repair bill would be much less than the agreements companies wanted.

The township will continue paying bills as repairs are needed, which is seldom.

Fornwalt said the developer was notified there were drainage problems on Falcon Court. The landscaping has been done and it is recommended the township accept the roads.

Supervisor Brian Dietrich said water is coming from a state road. Fisher said if the township takes the road over the drainage from the state road becomes a township problem.

Raber said the water could be forced to the sides from where it would run into the drainage system instead of across the road.

Supervisor Kermit DeLong said he would like to see some pictures taken during a storm to better understand the issues.

Fisher should prepare a deed of dedication for the solicitor and engineer to review.

A $1,000 escrow fund should pay the cost of preparing the deed of dedication, the review, filing of deed and preparing the final deed of dedication after review.

Raber alleged the developer, John Pergosky, is not holding up his end of the bargain because there is road work such as sealing storm drains to be done.

Smith said the township should take over the roads as a service to residents.

Dietrich asked that the money be increased to $2,500 from the developer to cover the cost of repairs. The engineer will be asked to develop drainage solutions.

On Broadtail Court there is a problem with horses running loose. Linda Generose alleged the owner ignores complaints and water has been tested and found contaminated by animal feces.

Dietrich said the zoning officer should be sent out and the Humane Society notified because the horses are hungry.

He said water runs down the road and Keystone Consulting or Carl Wolfe, sewage enforcement officer, should check.

The SEO will be asked to go out since the water is apparently coming from a sand mound.

Steven Keck, 7985 Kings Highway, will be asked to remove trash and debris as the first phase to cleaning his property. The second phase will be junk vehicle removal. If the steps are not taken the township will go to the district judge.

Frey and Company, Walnutport, agreed to audit the Lynn Sewer Authority's books for the first four months of 2012 for $2,500.

DeLong said former administrator Kevin Deppe has been gone a long time and some residents are saying he should be audited, which will happen with the township audit.

"It's time the community lets him alone," DeLong said.

Smith thanked Janet Henritzy for doing a good job in the absence of White, who was out for medical reasons.

Supervisor Steve Bachman of Heidelberg Township asked Smith about sharing services or employees with Lynn.

Until development picks up, Lynn supervisors see no reason to do so. The board may talk to Heidelberg later in the year.

The annual Beautify Lynn recycling day will take place April 20.
