Haines and Kiblehouse to halt biomass production

Solicitor Joseph Zator reports South Whitehall has been successful in an enforcement action against Huckleberry Associates, Haines and Kibblehouse, relating to production of biomass at the company's Huckleberry road facility.

"The township's position has been successful," Zator said at the Dec. 4 commissioners' meeting. "We obtained an injunction. They will stop bringing in composting materials but may finish what is already there."

H&K representatives have signed an agreement to avoid importing organic matter while the legal battle continues, Zator said, adding H&K built the compost plant without permits or approvals from the township.

Complaints from residents brought the matter to the attention of township staff.

Zator said a quarry on the property is in the process of reclamation.

He added H&K's main office in Skippack is in the business of quarrying and paving.

He said the zoning hearing board ruled against the company in favor of the township's position.

"While the legal battle continues, they won't bring more stuff in," Zator said. "The next step is if they appeal, which is expected."

In other business, commissoners considered a land development waiver request from Daryanani Enterprises for property at 1970 Pope Road, near the Nestle Pet Food facility.

Daryanani recently pruchased the property from an electrical contractor and wants to establish his own financial office on the site and sublet the remaining portion of the building.

During the discussion, commissioners learned things had been done to the property in the past without township approvals.

Impervious surface was added, and improvements were made without permits or inspections.

Gerald Harbison, director of community development, offered a suggestion.

"Let's have a resolution to look at the property and see what's missing from the puzzle," Harbison said.

Commissioners asked staff to prepare a resolution and work out a procedure for permits and inspections for presentation at a future meeting.
