Adult community plan fails due to zoning requirements

North Whitehall supervisors have denied the Strawberry Fields Adult Community plans for a development on 23 acres at Strawberry Acres, along Overlook Road.

Developer Py Patel's attorney, Richard Somach, was present to address North Whitehall supervisors at their Nov. 4 meeting, a continuance from last month.

He asked the township to stipulate all ordinances, special exceptions and variances be approved by the board so they could move ahead.

This, however, would mean over-riding the planning commission and zoning hearing board.

Solicitor Lisa Young said this was their third continuance.

The planning commission tabled the plan when they had it for review because there was not enough information presented.

Also, supervisors did not want to take over any sewer plant that might be installed to service the development.

The developer had been directed to contact the Lehigh County Authority to see if it would be interested in operating the plant but had not yet received a reply.

After some discussion, Supervisor Ronald Heintzelman made a motion to deny the plan based on required conditions noted in the zoning ordinance.

The motion was seconded and unanimously approved.

The developers options are now to appeal the supervisors decision or to present a new plan.

Some members of the audience commented on the plan.

Among them was Dan Nemeth who said the plan did not qualify because it was not on a 25-acre tract required by the zoning ordinance.

He said the developer could not submit a "by right" plan. He was also concerned about possible air pollution from the septic system and a decrease in property value, if the development proceeded.

In other business, Secretary Brenda Norder notified the board of the low bid for the salt contract for the winter season.

North Whitehall was part of a group of townships that bid on the salt as a unit with the low bidder being Cargill Salt with a price of $52.61 per ton.

Norder also said the township offices would be closed Nov. 28 and 29 for the Thanksgiving holiday.

Ron Roth pressed the board again to amend the zoning ordinance to address heliports and airports.
