A 76-year-old Schnecksville man was taken into custody after he allegedly raised his fist at a Berks-Lehigh Regional Police officer at the Cost Cutters Family Hair Salon, 1042 Millcreek Road, Lower Macungie Township.

According to an affidavit of probable cause obtained from District Judge Michael Faulkner, Robert Lewis Gross, of 4739 Doe Run Court, Schnecksville, was charged with resisting arrest and disorderly conduct.

State Police Trooper Peter Adam states in the affidavit he was dispatched to the hair salon 11:43 a.m. Aug. 21 to assist Berks-Lehigh Regional Police.

Adam says he saw Gross on the ground, handcuffed behind his back.

According to the affidavit, Adam interviewed Berks-Lehigh Regional Police Officer Nickolas Morris, who said he and Officer Dathan Schlegel were mistakenly dispatched to Millcreek Road by Lehigh County Radio for a disturbance in the hair salon.

Morris told Adam he and Schlegel were called there after Carl A. Gross, 73, and Carl A. Gross Jr., 48, allegedly got into a verbal argument in the waiting room of the salon.

While Morris was investigating the disturbance, Schlegel was allegedly approached by Robert Gross.

According to the affidavit, Robert Gross told Schlegel the disturbance would be settled if Gross Jr. would give Gross Sr. his truck keys. Robert Gross then stepped forward and brought up a closed fist, in a threatening manner, Schlegel said.

Schlegel forced him to the ground and tried to detain him but Gross continued to fight. Schlegel then deployed an electronic immobility device, similar to a Taser, on Gross. At that time, he was able to take him into custody, Schlegel said.

According to the affidavit, Schlegel sustained minor injuries to his hands and arms. Robert Gross was arraigned before District Judge Rod Beck, Slatington.
