Shooting, Burglary sentence
Lehigh County District Attorney Gavin P. Holihan announces an Allentown man will face a state prison sentence
in a 2024 shooting and burglary that occurred at a Fountain Hill pharmacy.
Miguel Angel Martinez, 57, of Allentown, pleaded guilty in May to felony charges of conspiracy to commit burglary, burglary and a misdemeanor charge of possessing instruments of crime.
In a hearing before Judge Anna-Kristie M. Marks on June 26, 2025, Martinez was ordered to
serve 8 to 20 years in state prison.
Also charged in the case is David Montes Vazquez, 34, of Bethlehem. He is charged with felony counts of conspiracy to commit burglary and to possession of a firearm prohibited as well as burglary, receiving stolen property and misdemeanor charges of conspiracy to recklessly endangering another person, conspiracy to make repairs/sell an offensive weapon, conspiracy to possession of a weapon and conspiracy to theft by unlawful taking.
Vazquez is scheduled for a status conference at 10 a.m. June 30, 2026 before Judge Marks.
Shortly after 9 p.m. Dec. 24, 2024, Fountain Hill Police were called to a sounding burglar alarm at the Fountain Hill Pharmacy at 1049 Broadway. Police arrived and saw two men inside the pharmacy, later identified as Martinez and Vazquez. Officers say Vazquez pointed a gun at a borough police officer who opened fire, but did not hit either defendant.
Residents were ordered to stay inside their homes during the standoff. Both defendants eventually surrendered to police. Both men broke into the pharmacy, spray painted surveillance cameras while inside and stole medication. This case was investigated by Fountain Hill Police Detective Raymond Anthony and Lehigh County Homicide Task Force Detectives Moses Miller and James Bruchak.
The cases were prosecuted by First Assistant District Attorney Patricia Fuentes Mulqueen and Assistant District Attorney Catherine A. Pleickhardt.
