Five cases approved; one postponed

Five cases were approved and one case was postponed by the Salisbury Township Zoning Hearing Board.

Approved in separate 5-0 votes at a three-hour hearing Sept. 10 in the township municipal building were:

- Appeal of Shadi Bitar, 818 S. Glenwood St., seeking variance relief to maintain a 188-square-foot building addition with a rear-yard setback of 25.6 feet (40 feet required) and to maintain a 178-square-foot accessory structure with a rear-yard setback of 1.2 feet (3 feet required).

The property is in the R3, Medium Low Density Residential zoning district.

The addition was to add a sunroom. The shed had been moved.

Bitar was represented by Attorney Naomi Centrella, associate, Fitzpatrick Lentz Bubba, PC.

Alternate Salisbury Township Zoning Hearing Board Solicitor, Attorney Matthew J. Deschler, of Shay, Santee, Kelhart & Deschler, LLC, represented the township.

Attorney Ian Baxter made the motion, seconded by Joseph Kovach, to bring the sunroom appeal to a vote.

Nicholas Birosik made the motion, seconded by Kovach, to bring the shed appeal to a vote.

- Appeal of David and Janine Allen, 854 E. Juniata St., requesting variance relief to maintain a 6-feet-high privacy-style fence within the required front yard setback (25 feet setback required; 1 foot provided). The property is in the R4, Medium Density Residential zoning district.

“Because the property is a corner lot, it has two front yards,” Salisbury Township Zoning Hearing Board Solicitor Attorney William Fries, senior counsel, Fitzpatrick, Lentz, and Bubba, PC said before the vote.

The fence replaced trees.

“The curb appeal is very attractive, compared to dead and dying trees,” Leno Scarcia, a neighbor, said.

“It looks much nicer with the fence,” Audrey Gleisl, a neighbor said.

Baxter made the motion, seconded by Kovach, to bring the fence appeal to a vote.

- Appeal of Patricia Ann Weibel, 2020 Sycamore Road, requesting variance relief to install a 14-feet by 22-feet accessory structure (shed), which would exceed the maximum permitted impervious coverage (15% permitted; 16% proposed) for the lot. The property is in the CR, Conservation Residential zoning district.

Barry Weibel, husband of Patricia Ann Weibel, said the 1 1/4 acre property was purchased in 1983, the house was built in 1984 and in 1985 the family moved in.

“It was 14 months of a labor of love we constructed. We love the township. I can’t say enough about Salisbury Township,” Barry Weibel said.

“It’s a house we would like to pass down. Let’s get everything down from the second floor to a shed. That’s the reason for the shed,” Barry Weibel said.

“The shed sort of matches the house. It’s a country Tudor,” Barry Weibel said.

“It’s a very well-maintained property,” Bob Skibbens, a neighbor said.

Birosik made the motion, seconded by Baxter to bring the shed appeal to a vote.

- Appeal of Cecilio Gonzalez on behalf of Esther Cosme, 1801 Broadway, requesting variance relief for a lot line adjustment-expansion of an existing nonconforming lot with a rear yard setback of 1.3 feet (15-feet setback required; 0 feet existing). The property is in the C2, Neighborhood Commercial zoning district.

- Appeal of Cecilio Gonzalez on behalf of Esther Cosme, 1770 Acker St., requesting variance relief for a lot line adjustment and construction of a new, single-family detached dwelling with a rear yard setback of 17.9 feet (35-feet setback required). The property is in the R4, Medium Density Residential zoning district.

The 1801 Broadway and 1770 Acker St. appeals were combined at the request of the township zoning board and with the consent of the applicants.

“The township would like to get all the commercial buildings on one lot and the house on one lot,” Salisbury Township Planning and Zoning Officer Kerry Rabold said before the vote.

“They’re going to vacate the alley and move the lot line so that building is connected to the commercial lot,” Rabold said.

“We are happy to comply with what the township is requesting,” Attorney William Marshall, representing Gonzalez on behalf of Cosme, said before the vote.

“Esther [Cosme] owns both properties [1801 Broadway, 1770 Acker St.]. Her husband Alex died in 2022,” Marshall said.

The property, 1801 Broadway, was purchased in 2004. It contains apartments and shops.

The property, 1770 Acker St., was purchased in 2020.

Cosme plans to build a house for herself at 1770 Acker St.

“It does get down to dimensional variances requests,” Fries said before the vote.

“I’m looking at it as a consolidation case. We can look at the hardship,” Fries said.

“From a practical standpoint, it makes sense cleaning up the lot lines,” said Baxter.

Birosik made the motion, seconded by Jessica Dunlap Yazujian, to bring the lot line adjustment appeals to a vote.

- Postponed was an appeal by Jonathan Solano, 940 S. 24th St., requesting variance relief to maintain a shed, roof over the rear patio, expanded driveway, pool, pool deck, pool fence and concrete patio. The property is in the R3, Medium Low Density Residential zoning district.

The Salisbury Township Zoning Hearing Board is next scheduled to meet 7 p.m. Oct. 1 in the meeting room of the municipal building, 2900 S. Pike Ave.
