House privacy fence approved in Salisbury Township

The Salisbury Township Zoning Hearing Board voted 5-0 at its July 9 meeting to approve the appeal of Mark Brezak and Leanna Brezak, 3105 Capital St., for variance relief to maintain a six-foot privacy-style wood fence within the required front-yard setback and construct a four-foot privacy-style wood fence within the same required front-yard setback.
Zoning Hearing Board Vice Chairman Attorney Ian Baxter made the motion, seconded by Zoning Hearing Board Member Nicholas Birosik, to bring the appeal to a vote.
The property, where the house fronts Capital Street, is along 31st Street in the R4, Medium Density Residential zoning district.
Mark Brezak, who is installing the fence, said the shopping center entrance is across the street from the house and because of vehicular traffic, “there’s a lot of cursing” from motorists. “Plus, when the train is passing, the cars back up. Deer actually hop into the yard. They run the railroad tracks.”
Mark Brezak is the father of Leanna Brezak. The house was purchased in January.
“Would the fence create a problem with the sight lines?” Zoning Hearing Board Chairman Attorney Kent Herman asked, referring to the Capital and 31st streets intersection.
“As for a sight triangle, it’s far enough away so that would not present a problem at the intersection,” Michele Lopez, Salisbury Township code enforcement officer, assistant zoning officer and rental inspector said. Lopez was in attendance for Salisbury Township Zoning Officer Kerry Rabold, who was absent.
“Let the record show that there are no objectors here,” Salisbury Township Zoning Hearing Board Solicitor Attorney William Fries of Fitzpatrick, Lentz, and Bubba, PC, said before the vote.
