Rockefeller Group cancels spot on township agenda

Rock Lehigh Valley LLC, an entity created by Rockefeller Group for a warehouse project along Weaversville Road, had the top spot on the agenda for Feb. 23, but the developer canceled at the last minute.

“This is the third time they canceled. I apologize to those of you who showed up to comment on the project. The delays also affect the township because we could have put other things on the agenda if we had known,” Chairman Roger Unangst said.

Last month, supervisors approved a new policy where zoning requests are not necessarily converted to zoning hearings. The township has no mandate to have a zoning hearing based on any request.

Many in the township oppose the warehouse development proposed by the Rockefeller Group along Weaversville Road. This meeting had a dozen residents in attendance; prior meetings had closer to a hundred. Residents were notified of the zoning hearing with a flier distributed earlier in the week.

The cancellation was posted on the website Feb. 22 when the township received the cancellation notice from the developer.

Unangst mulled his options.

“I promised that they would have a hearing, but I expected it to be tonight,” he said.

Solicitor Joseph Piperato suggested since the zoning request was approved before the new procedures were in effect, it would make sense to allow one more attempt at the zoning hearing.

“If they don’t show for the next hearing, then you are within your rights to pull the existing request. They can file again under the new procedures,” he said.

Supervisors agreed with the procedure.

Unangst asked the staff to alert Rockefeller Group they would be on the agenda some time from May on.

“There is no end date, but we will set it up when we can fit the hearing into our agenda,” he said.

The developer will be alerted that if representatives do not appear at the hearing, the zoning request will be pulled.

According to township Manager Deborah Seiple, the zoning notice will need to be reposted and advertised. The developer normally covers those costs.
