A Hanover Township man who was supposed to face trial this week in a fatal hit and run will wait until July 5 for his trial.
Royce Atkins, 22, was arraigned March 17 on criminal charges filed as a result of a Nov. 6, 2015, hit-and-run accident along Schoenersville Road that left a 9-year-old Sheckler Elementary School student dead.
With an original trial date of Monday, this trial has now been assigned to Judge Michael Koury, who has also scheduled a pretrial conference on June 10.
Atkins is represented by Philadelphia criminal defense lawyer Jack McMahon.
The Northampton County assistant district attorney assigned to prosecute this matter is Joseph Lupackino.
According to Colonial Regional Police, Darious Condash, along with a 14-year-old cousin and 15-year-old friend, had just left a Wawa store located about a quarter mile from Darious’ home at about 6:30 p.m. When he went back to pick up a piece of candy dropped on Schoenersville Road, he was struck and killed by Atkins’ blue Mazda. Atkins left the scene without stopping but admitted his involvement to Detective Gary Hammer three days later.
Atkins has been charged with failing to stop at an accident involving death or serious bodily injury. That is a second-degree felony with a mandatory minimum sentence of three years in prison and a mandatory minimum fine of $2,500.
He remains free on 10 percent of $50,000 bail.
Following a preliminary hearing Jan. 15, Magisterial District Judge James Narlesky found sufficient evidence to send the case to the Northampton County Court of Common Pleas.
