Charges filed in township homicide
A Whitehall Township man died April 4 from physical injuries sustained after being assaulted in his apartment April 3 by a Montgomery County man.
Brian S. Frank, 44, of 927 Third St., was pronounced dead 4:45 p.m. April 4 at Lehigh Valley Hospital, Cedar Crest, according to a Lehigh County coroner’s April 5 press release.
County Coroner Scott Grim ruled the manner of death homicide and determined the cause of death blunt force injuries to the head.
According to a Lehigh County District Attorney’s Office April 8 press release, Larry Ray Yaw, 32, of 1924 Big Road, Douglas Township, was charged April 4 with homicide, aggravated assault causing serious bodily injury, burglary of an occupied structure and a firearms offense.
According to the affidavit of probable cause, referred to in the Lehigh County District Attorney’s press release, Whitehall Township police responded to an assault at 927 Third St., Apartment 1, around 7:56 p.m. April 3.
An officer saw Frank bleeding from the face and back of the head and writhing in pain. Frank was unable to speak and was transported to the hospital for treatment, the press release said.
Frank’s roommate told police Frank and a woman named Chyanne Carwell were in the apartment April 2 until around midnight.
Frank told the roommate he was leaving to take Carwell home to Gilbertsville. Frank returned to the apartment between 1:30 and 2 a.m. April 3, the roommate told police.
The press release said Frank’s roommate and girlfriend were awakened by a loud noise the morning of April 3, and the bedroom door was kicked in.
A man the roommate knew as Larry entered the room carrying a small black handgun.
Larry said, “Oh, wrong room,” the press release noted.
The roommate told police he saw the handgun in Larry’s right hand and a baseball bat in his left hand.
Larry then left the room, at which time the roommate heard a gunshot and then Frank screaming in pain, the press release continued.
The roommate then looked out of the room and saw Carwell standing next to a refrigerator and Larry walking out of Frank’s room.
According to the press release, Larry told the roommate, “If you tell the cops I was here, I will be back for you.”
The press release indicated the roommate’s girlfriend informed police she witnessed Carwell in the apartment with Frank April 2, and she was aware of Frank transporting Carwell home.
The press release said Yaw is being arraigned in the Lehigh County Central Booking Center. Because the case involves a homicide, no bail has been set.
According to the press release, police in New Hanover Township, Montgomery County, and Pottstown assisted Whitehall Township police and the Lehigh County District Attorney’s Homicide Task Force with the investigation.
