Whitehall man charged in fatal Route 22 crash

A Whitehall Township man was charged April 3 with homicide by vehicle while driving under the influence of alcohol and other offenses in a November 2012 fatal crash on Route 22 in the township.

Pennsylvania State Police charged Tyron Abraham Martin Jr., 28, of 750 Apt. G, Mickley Run Road, with one count of homicide by vehicle while driving under the influence of alcohol, a second-degree felony; two counts of aggravated assault by vehicle while driving under the influence, a second-degree felony; one count of homicide by vehicle, a third-degree felony; three counts of accidents involving death or personal injury while not properly licensed, a third-degree felony; two misdemeanor counts of driving under the influence of alcohol; one count of involuntary manslaughter, a first-degree misdemeanor; and summary offenses of driving with a suspended or revoked license, driving without insurance, driving on roadways laned for traffic, driving a vehicle at an unsafe speed, careless driving, reckless driving and driving a vehicle with expired inspection.

Martin was charged in the death of William H. Wilson III, 24, of Stewartsville, N.J., and with causing serious injuries to two other people who were involved in the four-vehicle crash on Route 22 westbound at the construction zone at Route 145. Martin's blood alcohol content was determined to be .22 percent shortly after the crash.

Martin was arraigned by District Judge David Harding, and bail was set at $100,000.

According to an affidavit of probable cause filed by Pennsylvania State Police Troop M, Bethlehem:

At about 2:26 a.m. Nov. 16, 2012, a state trooper on routine patrol in the area of Route 22 near the Fullerton Avenue ramp noticed that traffic had stopped in the westbound lanes. The trooper proceeded west on Route 22 on the north shoulder and saw a multivehicle crash in an active construction zone.

Illuminated signs had been posted to warn motorists of the construction zone ahead, and orange signs had been posted at the zone. In addition, plastic cones had been erected in a westerly direction that marked the closure of the right travel lane.

The trooper saw a vehicle with severe front and passenger side damage. Martin, who was trapped in the vehicle, was taken to Lehigh Valley Hospital, Salisbury Township, for treatment.

Another vehicle with severe rear damage was on its roof in the westbound left travel lane. The driver, Wilson, had been partially ejected from the vehicle. The Lehigh County Coroner's Office pronounced Wilson dead at the scene and determined that the cause of death was blunt force trauma to the head and neck as a result of the crash.

State police interviewed witnesses who said that Wilson's vehicle was stopped in the left westbound travel lane because the right lane was closed in the construction zone. The vehicle driven by Martin was traveling at a high rate of speed when it struck the right rear bumper of Wilson's vehicle.

Martin's vehicle then spun and struck a semi-trailer that was stopped in the right travel lane.

The force with which Wilson's vehicle was struck propelled the vehicle into the center cement median. The vehicle then flipped over and struck another vehicle.

A passenger in Wilson's vehicle and the driver of the vehicle that Wilson's vehicle struck sustained injuries.

A state trooper performed an accident reconstruction and determined that no mechanical or environmental factors caused the accident.
