Use of fireworks
In Bethlehem, Pennsylvania, the use of consumer fireworks is regulated by both state law and local ordinances. The state law allows the purchase and use of consumer fireworks (like firecrackers and Roman candles containing 50 mg or less of explosive material) by those 18 and older. However, permission from the property owner is required for use on private property, and they cannot be used within 150 feet of an occupied structure. Bethlehem also has restrictions on the time of use, generally prohibiting them between 9 p.m. and 9 a.m., except for special events with a permit.
As of October 2017, consumer grade fireworks are legal to purchase and possess across the State of Pennsylvania. However, the use of fireworks remains limited by state law. In order to use consumer fireworks, a person must be 18 years of age or older, but a person may not intentionally ignite or discharge consumer fireworks:
(1) Between the hours of 9 a.m. and 9 p.m.
(2) On public or private property without the express permission of the owner.
(3) Within or from a motor vehicle or building.
(4) Into or at a motor vehicle or building or at another person.
(5) While the person is under the influence of alcohol, a controlled substance or another drug.
(6) Within 150 feet of an occupied structure: A structure, vehicle or place adapted for overnight accommodations of persons for conducting business whether a person is actually present.
