Hanover Township Engineer Frederick Hay asked the township council to approve a small public works project at the swale near the Friendly's Restaurant on the corner of Airport Road and Catasauqua Road.
According to Hay, there is a swale, owned by the township, on the restaurant's Catasauqua Road frontage that has been troublesome for years.
"Several drain pipes come into the location," he said in his remarks. Hay proposed that the township cover the swale and reroute the storm water drainage from the parking lots of the Red Roof Inn, Friendly's and the Red Robin Restaurant.
Hay said the Friendly's management agreed to mow the grass, if it is filled and leveled. Hay had asked contractors for bids and J.C. Sons Excavating, Inc., of Whitehall, was the low bidder at $11,000. The township will supply materials valued at $5,500. Council approved the expense unanimously.
Solicitor Jackson Eaton asked council for permission to draft a revision of the township charter. There are provisions in the charter that allow for a recall of an elected official under certain conditions. According to Eaton, the Pennsylvania Supreme Court ruled that a recall is not a constitutional way for citizens to remove elected officials, so Eaton asked for permission to make changes in the charter to match the state law.
"If the court ruled on it, then the provision in the charter has no meaning?" asked Councilman Michael Woolley.
Eaton agreed with Woolley's interpretation and suggested the charter revision, which must be approved by voters.
