UPPER MILFORD SUPERVISORS Property owner responsible for detention pond maintenance, supervisors say

Upper Milford Township supervisors, following up a request made at a previous meeting, told a Mink Estates couple they are responsible for maintenance of a detention pond on their property.

At their Sept. 20 meeting, Township Manager Daniel DeLong told supervisors and Edgar and Dolores Hausman the township solicitor has researched the deed, development plan and Homeowners Association agreement and determined the pond maintenance is the responsibility of the owner of the property.

The Hausmans had complained the condition of the pond is deteriorating.

At last week's meeting, Mr. Hausman contended the developers signed an agreement turning upkeep of the pond over to the township.

"They did sign a deed of dedication of the road to the township," DeLong replied, but not for the pond or any other stormwater facilities.

Township solicitor Marc Fisher said he could do a title search to determine if the document Mr. Hausman talked about exists.

A neighbor, Frank Caputo, agreed with supervisors the pond is the homeowners' responsibility, but asked who is responsible for the pipe that goes from the pond under the road. That pipe is rusted and contributing to the problems with the pond, he said.

Supervisors George DeVault urged everyone involved in the issue to try to find any relevant documents so work on addressing the problem can begin.

"The drainage is a serious problem," DeVault said.

In other business, supervisors received correspondence from the Recreation Commission regarding possible township purchase of property at 5056 Vera Cruz Road to add to Jasper Park. Although at a previous meeting, recreation commission members had encouraged the purchase, saying it would improve access to the park, the commission has determined after further investigation that "acquiring the property would not serve the goal of improving access" and recommended against the purchase.

Supervisors also met in executive session for an hour prior to the scheduled meeting, and for another 20 minutes during the workshop portion of the meeting. Both sessions were about personnel issues, but Supervisors Chairman Daniel Mohr said they were two separate issues.
